(၇၆) ကြိမ်မြောက် ကုလသမဂ္ဂအထွေထွေညီလာခံ တတိယကော်မတီ အစည်းအဝေးအတွင်း “မြန်မာနိုင်ငံရှိ ရိုဟင်ဂျာမွတ်စလင်များနှင့် အခြားလူနည်းစုများ၏ အခွင့်အရေးဆိုင်ရာ ဆုံးဖြတ်ချက် အဆိုမူကြမ်း” အား အတည်ပြုဆုံးဖြတ်ရာတွင် မြန်မာအမြဲတမ်းကိုယ်စားလှယ်က ပါဝင်ဆွေးနွေးပြောကြားခဲ့

၁။ (၇၆) ကြိမ်မြောက် ကုလသမဂ္ဂအထွေထွေညီလာခံ တတိယကော်မတီ အစည်းအဝေးအတွင်း အီးယူ နှင့် အိုအိုင်စီ တို့ ပူးတွဲတင်သွင်းသည့် “မြန်မာနိုင်ငံရှိ ရိုဟင်ဂျာမွတ်စလင်များနှင့် အခြားလူနည်းစုများ၏ လူ့အခွင့်အရေးဆိုင်ရာ ဆုံးဖြတ်ချက်အဆိုမူကြမ်း” အား အတည်ပြုဆုံးဖြတ်ရာတွင် မြန်မာအမြဲတမ်း ကိုယ်စားလှယ် သံအမတ်ကြီး ဦးကျော်မိုးထွန်း က ပါဝင်ဆွေးနွေးပြောကြားခဲ့ရာတွင် အောက်ပါအချက် များကို အဓိကပြောကြားခဲ့ပါသည်-
(က) ယခုဆုံးဖြတ်ချက်အဆိုမူကြမ်းတွင် ရိုဟင်ဂျာများ၏ အခြေအနေကို ကောင်းစွာရှင်းလင်းပေးထား ပြီး ၎င်းတို့၏ အခွင့်အရေးများကို မည်သို့လေးစားကာကွယ်ပေးနိုင်မည်ကို ဖော်ပြထားသည့်အတွက် ကျေးဇူးတင်ကြောင်း၊ ရိုဟင်ဂျာအရေးကိစ္စသည် မြန်မာနိုင်ငံမှ ရင်ဆိုင်နေရသည့်ကိစ္စများ အနက်တစ်ခုဖြစ် သည်ကို အလေးပေးဖော်ပြလိုကြောင်း၊ ယင်းကိစ္စရပ်ကို မြန်မာနိုင်ငံကသာလျှင် အဓိကဖြေရှင်းဆောင်ရွက် နိုင်သည်ဆိုသည့်အမြင်ကို လက်ခံကြောင်း၊ ယင်းအတွက် ရေရှည်တည်တံ့သည့်ဖြေရှင်းမှုကို ရှာဖွေရာတွင် အားလုံးပါဝင်ပြီး ဘက်စုံထောင့်စုံမှ ချဉ်းကပ်အဖြေရှာရမည်ဖြစ်ကြောင်း၊ မြန်မာနိုင်ငံရှိ အခြားရင်ဆိုင်နေရ သည့် ပြဿနာများကို အချိန်မီတုံ့ပြန်ရန် လိုအပ်ကြောင်း၊ ယင်းကိစ္စများကလည်း အခြားကိစ္စရပ်များကို ထိခိုက်စေနိုင်သည့်အတွက် ကိုင်တွယ်ဖြေရှင်းရန်လည်း အရေးကြီးကြောင်း၊ သို့ဖြစ်၍ ပြဿနာများကို နည်းလမ်းပေါင်းစုံဖြင့် ရှုမြင်သုံးသပ်ဖြေရှင်းရန် အရေးကြီးကြောင်းကို အလေးပေးဖော်ပြလိုကြောင်း၊
(ခ) မြန်မာနိုင်ငံတွင်၊ အထူးသဖြင့် ဖေဖော်ဝါရီလ ၁ ရက်နေ့ အာဏာသိမ်းမှုဖြစ်စဉ်နောက်ပိုင်းတွင် ပြည်သူအားလုံးသည် စစ်တပ်၏အကြမ်းဖက်မှုများနှင့် လူမဆန်သည့်လုပ်ရပ်များကို ကြုံတွေ့ခံစားနေကြရ သည်မှာ မငြင်းနိုင်ကြောင်း၊ မြန်မာ့စစ်တပ်က ဖေဖော်ဝါရီလ ၁ ရက်နေ့မတိုင်မီနှင့် နောက်ပိုင်းတွင် ကျူးလွန် ခဲ့သည့် ကြမ်းကြုတ်ရက်စက်သည့် လုပ်ရပ်များ၊ အတင်းအကြပ်ဖမ်းဆီးခြင်း၊ ညှဉ်းပန်းနှိပ်စက်ခြင်းနှင့် လူသားမျိုးနွယ် အပေါ်ကျူးလွန်သည့် ရာဇဝတ်မှုများနှင့် ပတ်သက်၍ ကျယ်ကျယ်ပြန့်ပြန့်မှတ်တမ်းများ ရှိပြီးဖြစ်ကြောင်း၊ ကုလသမဂ္ဂ၏ ကိုယ်စားလှယ်များနှင့် တာဝန်ရှိပုဂ္ဂိုလ်များကလည်း အကျယ်တစ်ဝင့် ရှင်းလင်းပြောကြားခဲ့ကြကြောင်း၊ ယင်းသည် မြန်မာပြည်သူတစ်ရပ်လုံး အကြမ်းဖက်စစ်တပ်၏ ပစ်မှတ်ထားဖိနှိပ်မှုခံနေရသည်ကို ရှင်းလင်းစွာဖော်ပြလျက်ရှိကြောင်း၊ ဒီမောဆိုး၊ ကနီ၊ ထန်တလန်မြို့နယ် များ၌ ဖြစ်ပွားခဲ့သည့် ဝမ်းနည်းဖွယ်ဖြစ်စဉ်များသည် စစ်တပ်၏ လူမဆန်သည့် အကြမ်းဖက်လုပ်ရပ်များ အတွက် ခိုင်မာသည့် သက်သေများဖြစ်ကြောင်း၊
(ဂ) မြန်မာနိုင်ငံနှင့် ပြည်သူအားလုံးအတွက် အချိန်သည် အလွန်အရေးပါကြောင်း၊ ထို့အပြင် နိုင်ငံတကာ အသိုက်အဝန်းအနေဖြင့် ပြည်သူများ၏ အသက်အိုးအိမ်များနှင့် ဆက်စပ်အရေးပါသည့် မြန်မာနိုင်ငံအတွင်း ဖြစ်ပွားလျက်ရှိသည့် အခြေအနေများကို အလေးအနက်ထား အာရုံစိုက်ရန် အရေးကြီးကြောင်း၊ ဆုံးဖြတ်ချက်အဆိုသည် ရိုဟင်ဂျာများနှင့် အခြားလူနည်းစုများ၏ လူ့အခွင့်အရေးကို ဖြေရှင်းပေးရန် ရည်ရွယ်သည်ကို နားလည်ပါကြောင်း၊ လက်ရှိဖြစ်ပေါ်နေမှု အခြေအနေများနှင့် ဓမ္မဓိဋ္ဌာန်ကျရန် အရေးပါ သကဲ့သို့၊ လက်ရှိမြေပြင်အခြေအနေများကို ထင်ဟပ်ဖော်ပြပေးရန်လည်း အရေးကြီးကြောင်း၊ ထို့အပြင် ပြစ်မှုကျူးလွန်သူများကို အရေးယူတာဝန်ခံစေရန်အတွက် နိုင်ငံတကာအသိုက်အဝန်းကို တိုက်တွန်းရန် မှာလည်း အရေးကြီးကြောင်း၊
(ဃ) ပြည်သူတစ်ရပ်လုံး၏ ကံကြမ္မာသည် ပြည်တွင်းပြည်ပတွင် နေထိုင်သူအားလုံး၏ ဘဝများအပေါ် သက်ရောက်မှုဖြစ်စေကြောင်း၊ မြန်မာနိုင်ငံအတွင်းရှိ လူနည်းစုများ၏ အခွင့်အရေးကို ကာကွယ်မြှင့်တင်ရန် ရည်ရွယ်သည့် ဆုံးဖြတ်ချက်အဆိုအနေဖြင့် ပြည်သူတစ်ရပ်လုံးအပေါ်ဖြစ်ပွားနေသည့် အခြေအနေများကို လျစ်လျူမရှုသင့်ကြောင်း၊ မိမိတို့သည် တရားမျှတမှုအတွက် တိုက်ပွဲဝင်နေခြင်းဖြစ်ပြီး မြန်မာနိုင်ငံတွင် တရားမျှတမှုသည်သာ ကြီးစိုးရမည်ဖြစ်ကြောင်း၊
(င) နိုင်ငံတကာအသိုက်အဝန်းအနေဖြင့် မိမိတို့၏ တရားမျှတမှုတိုက်ပွဲကို ကူညီပေးရမည် ဖြစ်ကြောင်း၊ ယခုဆုံးဖြတ်ချက်အဆိုမူကြမ်းသည် မြန်မာပြည်သူများကို နည်းပေါင်းစုံဖြင့် အထောက်အကူဖြစ်မည်ဟု မျှော်လင့်ပါကြောင်း၊ ပြည်သူအချင်းချင်းအကြား နားလည်မှုမလွဲစေဘဲ သဟဇာတဖြစ်စေရန် မျှော်မှန်း ပါကြောင်း၊ ထို့ကြောင့် ယခုဆုံးဖြတ်ချက်အဆိုသည် တရားမျှတပြီး ထိရောက်ရန် အရေးကြီးကြောင်း၊ သို့ရာတွင် ယင်းသည် ပြည်တွင်းရှိ မြေပြင်အခြေအနေများကို လုံလောက်စွာ ဖော်ပြနိုင်ခြင်းမရှိကြောင်း၊ အဆိုမူကြမ်းပါအချက်များကို ပိုမိုကောင်းမွန်အောင် ပြင်ဆင်နိုင်သည်ဟု မြင်ကြောင်း၊
(စ) ထိတွေ့ညှိနှိုင်းမှုသည် နိုင်ငံတကာဆက်ဆံရေးမျက်နှာစာတွင် အဓိကမူတစ်ခုဖြစ်ပါကြောင်း၊ ယခု အဆိုမူကြမ်းတွင် ပါဝင်သည့်အချက်များသည် နိုင်ငံနှင့် ပြည်သူများ၏ အနာဂတ်အတွက် အရေးကြီး ကြောင်း၊ အဆိုမူကြမ်းကို ညှိနှိုင်းသည့်လုပ်ငန်းစဉ်တွင် သက်ဆိုင်သည့်နိုင်ငံကို ဖိတ်ကြားပါဝင်စေသင့် သော်လည်း ယင်းသို့ ဆောင်ရွက်ခဲ့ခြင်းမရှိကြောင်း၊ ထို့အပြင် အချို့သောအဖွဲ့ဝင်နိုင်ငံများ၏ အဆိုပြုချက် များကိုလည်း ထည့်သွင်းစဉ်းစားခြင်းမရှိကြောင်း၊ ယင်းသည် စိတ်ပျက်ဖွယ်ဖြစ်ပြီး အဆိုပါဆွေးနွေး ညှိနှိုင်းသည့်လုပ်ငန်းစဉ်ကို ယခုထက်ပိုကောင်းမွန်စေသင့်ကြောင်း၊
(ဆ) သို့ဖြစ်၍ အဆိုမူကြမ်းသည် ဘာသာရပ်ပိုင်းနှင့် လုပ်ငန်းစဉ်ပိုင်းတို့တွင် တိုးတက်ရန် လိုအပ်သည်ဟု ခိုင်မာစွာရှုမြင်ကြောင်း၊ သို့ရာတွင် ရိုဟင်ဂျာများအား လက်ခံပံ့ပိုးမှုနှင့် ၎င်းတို့နှင့် တစ်သားတည်းရှိမှုကို ပြသနိုင်ရန်အတွက် ယခုအဆိုမူကြမ်းကို ထောက်ခံသွားမည်ဖြစ်ကြောင်း၊
(ဇ) မိမိတို့ ပြည်သူအားလုံးအနေဖြင့် စစ်တပ်မှဖန်တီးသည့် လူ့အခွင့်အရေးနှင့် လူသားချင်းစာနာမှု အကြပ်အတည်းများကို ရင်ဆိုင်ကြုံတွေ့နေကြရကြောင်း၊ အုပ်ချုပ်မှုအာဏာကို ဒီမိုကရေစီနည်းကျ ရွေးကောက်တင်မြှောက်သည့် အစိုးရလက်ထဲသို့ ပြန်လည်လွှဲပြောင်းရန်၊ မတရားဖမ်းဆီးချုပ်နှောင်ခံရ သူများကို ခြွင်းချက်မရှိ လွှတ်ပေးရန်၊ အာဏာသိမ်းမှုမတိုင်မီနှင့် နောက်ပိုင်းတွင် ကြီးလေးသည့် ရာဇဝတ်မှု ကျူးလွန်သူများကို တာဝန်ခံစေရန်၊ စစ်တပ်ကို ဒီမိုကရေစီနည်းကျ အရပ်သားအစိုးရ၏ လက်အောက်တွင် ထားရန်နှင့် ဒီမိုကရေစီ၊ တရားမျှတမှု၊ သာတူညီမျှမှုနှင့် တရားဥပဒေစိုးမိုးရေးတို့အပေါ် အခြေခံ၍ ဖယ်ဒရယ်ဒီမိုကရက်တစ်ပြည်ထောင်စုကို တည်ဆောက်ရာတွင် မြန်မာပြည်သူများ၏ အားထုတ်ကြိုးပမ်းမှု ကို နိုင်ငံတကာအသိုက်အဝန်းက လက်ကမ်းကူညီဖေးမပေးရန် လွန်စွာအရေးကြီးကြောင်း။
၂။ အဆိုပါဆုံးဖြတ်ချက်အဆိုမူကြမ်းကို ၁၇-၁၁-၂၀၂၁ ရက်နေ့၊ နံနက်ပိုင်းတွင် တူညီဆန္ဒဖြင့် အတည်ပြုချမှတ်ခဲ့ပါကြောင်း ဖော်ပြအပ်ပါသည်။
၃။ မြန်မာအမြဲတမ်းကိုယ်စားလှယ် ပြောကြားခဲ့သည့် မိန့်ခွန်းအပြည့်အစုံ (အင်္ဂလိပ်ဘာသာ) အား ပူးတွဲ ဖော်ပြအပ်ပါသည်။

Statement by Myanmar at the Third Committee of 76th UNGA during the consideration of the draft resolution A/C.3/76/L.30/Rev.1 “Situation of human rights of Rohingya Muslims and other minorities in Myanmar”

Mr. Chair.
Myanmar takes note of the draft resolution L.30_Rev 1 jointly tabled by the EU and the OIC. In this regard, Myanmar wishes to make the following points:-
1. We are grateful that the situation of Rohingya is well-explained and that how their rights be respected and protected in this resolution. We call for the member states to help implement the provisions contained therein. We wish to stress that the issue of Rohingya is a part of the issues Myanmar is facing. We share the view that Myanmar is only in the position to address this issue. It is imperative that the issue should be addressed in multidimensional approach and in a holistic manner in order to find a sustainable solution. It is also critical to oversee the other problems that required the timely response and that could also affect other situations. In this regard, Myanmar wishes to underline the importance of viewing, identifying and solving the problems in all possible ways.
2. It cannot be denied that, in Myanmar, all people have been suffering the atrocities and inhumane actions of the military, especially after the military coup on 1 February. Myanmar military has committed ruthless and violent acts, arbitrary arrests, tortures and crimes against humanity before and after the military coup. Such terrorizing and inhumane acts of the military have been widely reported and documented. A number of UN officials and representatives including the UN Special Rapporteur on human rights situation in Myanmar, the Special Envoy of the Secretary General on Myanmar and the head of IIMM well explained such atrocities. On 5 November 2021, the head of IIMM even highlighted that the situation that followed the military coup in Myanmar included rising violence and widespread and systematic attacks against the civilian population amounting to crimes against humanity. This clearly underlined that currently the whole civilian population have been targeted and persecuted by the military junta. From the UN Security Council session last week, it was evident that the situation in Myanmar has worsened day by day, with the increase attacks of the military to the civilians in different parts of the country, mass killings on the civilians, with the hundreds of thousands of civilians fleeing from their homes. The tragic events in Demoso in Kayah State, Kani in Sagaing Region and ThantLang in Chin State were the strong proofs of the military’s inhumane and terrorist acts.
3. Time is of the essence for the country and for all people in Myanmar. Also, it is critical that the international community pays serious attention to what is happening in Myanmar where the lives of the civilians are at stake. Although it is understandable that the resolution intends to address the situation of human rights of Rohingya and other minorities in Myanmar, it is important to be objective and it is also pertinent that the resolution reflects and gives sufficient information on the real and updated situation on ground and it should be addressed in a holistic manner. It is also critical to urge the international community to hold those perpetrators accountable for those atrocities they have committed.
4. The fate of the whole population will certainly affect to the lives of the others living inside and outside the country. The resolution intending to protect and promote the rights of minorities in Myanmar should not neglect what has been happening to the whole populations. Here I wish to recall the words of Martin Luther King Jr, “Injustice anywhere is a threat to justice everywhere”. This is where we are and we are fighting for justice. Justice must prevail in Myanmar for everyone.
5. Therefore, the international community must help us in our fight for justice for everyone. We strongly expected that this draft resolution would contribute in that way to all people in Myanmar. We hope that this draft resolution would not create misunderstanding among us rather would bring harmony for all people in Myanmar. Therefore, it is important that the resolution should be a balanced, just and effective one. Myanmar is concerned that this draft resolution does not reflect sufficiently and adequately the on-ground and updated situation in Myanmar. We are of the view that it could be improved in many ways.
6. Finally, we all share the view that engagement is a core principle for multilateralism. We consider that the elements contained in the draft resolution are important for the future of the country and the people. The country concerned should have been invited to involve in the negotiation process though we expressed our interest. This is clearly lacking in this case. Most importantly, some pertinent proposals from some member states were not taken along. It is disappointing. Definitely, the negotiation process should be improved.
As such, our delegation strongly views that the draft resolution needs to be improved in terms of substance and procedure. However, demonstrating our support towards Rohingya people and our solidarity with them, we will support the resolution.
In conclusion, Mr. Chair, we are encountering the human rights and humanitarian tragedy created by the military. It is critically important that the international community should extend its helping hands to all people of Myanmar in our efforts to create condition in which state power is handed over to the democratically elected government, all unlawful detainees should be released unconditionally, the transitional justice and accountability is ensured for serious crimes committed before and after the military coup, the military is put under the democratic civilian control, and a federal democratic union is built based on the principles of democracy, equality, justice and the rule of law.
