Statement by Ambassador Kyaw Moe Tun, Permanent Representative of the Republic of the Union of Myanmar to the United Nations, at the Sixth Committee of the Eighty-first Session of the UN General Assembly: General Debate on United Nations Conference of Plenipotentiaries on Prevention and Punishment of Crimes against Humanity

(New York, 12 October 2026)

Madam. Chair,

Allow me at the very outset to commend the sustained commitment of Member States to advancing this vital initiative to close existing gaps in the international legal framework and strengthen accountability for crimes against humanity, the most serious crimes of concern to the international community.

We also appreciate the International Law Commission for its dedicated work on the draft articles for consideration by the United Nations Conference of Plenipotentiaries on Prevention and Punishment of Crimes against Humanity, as well as the working group for their constructive engagement.

Madam Chair,

The concept of crimes against humanity, first codified in the 1945 Nuremberg Charter, has served as a cornerstone of international criminal law for over seven decades.

Under international law, crimes against humanity constitute breaches of obligations erga omnes. However, gaps remain, and a dedicated convention to ensure effective prevention, accountability, and cooperation at the national level is still absent in many cases.

Aside from historic atrocities, present global crises involving ethnic cleansing and genocidal offenses against human dignity are unprecedented. These harrowing events underscore the urgent need for concrete action to prevent, prosecute, and punish these grave crimes.

At this critical juncture, there is a pressing need to address crimes against humanity through a robust international legal framework, and Myanmar speaks from its own direct experience.

Since the February 2021 illegal military coup, the military junta has committed grave human rights violations against civilians across the country.

More than 8,500 people, irrespective of gender, age, health, or ability, have been killed by the junta through the most brutal methods, with the escalating use of airstrikes serving as one of its most lethal means. Mass killings continue to take place across various regions of Myanmar.

However, the full extent of the junta’s atrocities does not end there.

Its intensified campaign of terror across the country has contributed to the loss and damage of civilian lives and infrastructure.

OCHA Myanmar reports that the humanitarian crisis continues to affect more than 16.2 million people in immediate need of assistance.

The most recent report by the UNDP also reveals that more than two in three people now endure multidimensional poverty or are at risk of falling into it.

Moreover, the future of our youth is severely compromised by the junta’s forced conscription.

For far too long, our children lack access to quality education and fundamental healthcare. Women and girls face sexual and gender-based violence. Many have suffered severe physical trauma and life-altering injuries as a result of the junta’s brutality. These situations are far worse in conflict-affected areas.

Yet, the junta continues to block humanitarian access, withhold life-saving aid, and attack humanitarian personnel.

Furthermore, Myanmar has turned into a global hub for industrial-scale cyber-scams, human trafficking, modern slavery, and the record-high manufacturing of synthetic drugs, including mass-market methamphetamine and ketamine that flood the entire Asia-Pacific region.

Meanwhile, the junta continues to spread misinformation and disinformation.

Following its sham elections, the junta has attempted to disguise itself as a civilian government in an effort to gain international legitimacy.

It is particularly concerning to see some countries engaging with perpetrators of war crimes and crimes against humanity for transactional purposes.

I must therefore stress that impunity must not bypass humanity.

In the case of Myanmar, any actions that contradict the aspirations of the Myanmar people must cease.

UN Member States need to make effective use of the evidence collected by the Independent Investigative Mechanism for Myanmar (IIMM) to hold criminals accountable, rather than granting them the diplomatic visibility they seek for international legitimacy.

Madam Chair,

Myanmar regards crimes against humanity as serious violations of the law and an assault on the very essence of what it means to be human. When we fail to address crimes against humanity, we not only fail the victims, but we also diminish our own humanity.

Perpetrators of genocide, ethnic cleansing, war crimes, and crimes against humanity shall never obtain legitimacy under the guise of political power.

In this regard, we reaffirm our support for provisions requiring preliminary measures when an alleged suspect is present. These measures are vital to ensuring that jurisdiction is genuinely effective, and that accountability does not remain a mere abstraction. We urge all States to carefully consider how these rules are applied in practice.

Myanmar additionally emphasizes the applicability of the obligation of non-refoulement in cases where persons are exposed to a foreseeable danger of crimes against humanity if returned. Considering the ongoing plight of Myanmar citizens, this protection remains vital to fulfilling the preventive mandate of the draft text.

Madam Chair,

For Myanmar, a binding convention on crimes against humanity is an urgent matter of survival, given years of systematic atrocities and a domestic legal system hijacked by the perpetrators.

Myanmar calls on the international community to adopt a robust, enforceable convention that closes legal gaps, denies safe havens, and mandates strong state cooperation on extradition and mutual legal assistance.

The ILC draft articles seek to address these gaps by clarifying State obligations, reinforcing domestic jurisdiction, and enhancing interstate cooperation.

Thus, we look toward the upcoming sessions of the Preparatory Committee and the diplomatic conference. We must make use of the momentum and approach the draft articles with a shared sense of urgency, ensuring that the final convention is strong, enforceable, and leaves no room for impunity.

Myanmar stands ready to engage constructively with all delegations.

I thank you.
